1. Program Description

My Travel Lion in conjunction with Down Under Promotions (the “Company,” “we,” “us,” or “our“) is offering a mobile messaging program (the “Program“) that allows customers and subscribers to receive text messages (SMS) communications on their mobile phone. By opting in to or participating in this Program, you (the “Subscriber” or “you“) accept and agree to these Mobile Messaging Terms and Conditions and our Privacy Policy (collectively, the “Agreement“).

Program Sponsor: Down Under Promotions

Product/Service Description: My Travel Lion in conjunction with Down Under Promotions offers both free and paid all-inclusive vacation and travel destinations.


2. Opt-In and Consent

2.1 Express Written Consent

You acknowledge and agree that:

  • You are providing prior express written consent to receive SMS/text messages from the Company
  • You are not a user of any national or state Do Not Call registry that would restrict such messaging
  • Sending an SMS message requires your affirmative action and willingness to participate in this Program
  • You understand that consent to the Program is not a condition of purchasing any goods or services from the Company

2.2 Methods of Opting In

You may opt in to receive messages through:

  • Completing an unchecked opt-in checkbox on our website or application
  • Texting a keyword (e.g., “JOIN”) to a designated short code
  • Submitting your mobile phone number through a web form
  • Any other method explicitly offered by the Company

3. Message Frequency and Content

3.1 Expected Message Frequency

You understand that by opting in to this Program, you may receive the following types and approximate frequency of messages:

  • Promotional offers
  • Frequency: Approximately 2 messages per month
  • Standard message rates from your wireless carrier may apply

3.2 Message Content

Messages may include:

  • Marketing and promotional content
  • Product updates and announcements
  • Transactional notifications (order confirmations, shipping updates, etc.)
  • Account information and alerts
  • Customer service communications
  • Surveys or requests for feedback

The Company is not responsible for delayed or undelivered messages.

3.3 Prohibited Content

The Company will not send messages containing:

  • Prohibited content (spam, fraudulent information, violence, inappropriate material, hate speech)
  • Gambling promotions or adult content (unless specifically authorized)
  • Illegal product promotions (drugs, firearms, etc.)

4. Opt-Out and Unsubscribe

4.1 How to Opt-Out

You may opt out of receiving further SMS messages by:

  • Texting “STOP” to any message you receive from the Program
  • Replying with “STOP“, “UNSUBSCRIBE“, “QUIT“, or similar language
  • Visiting our website and updating your SMS preferences

4.2 Opt-Out Processing

Upon receiving your opt-out request:

  • The Company will confirm your opt-out status with a final confirmation message (if applicable under carrier guidelines)
  • You will be removed from the Program within 24 hours
  • The Company will not send you further promotional messages
  • You may still receive transactional messages (e.g., order confirmations, account notifications)

5. Carrier and Standard Message Rates

5.1 Standard Message Rates Apply

  • You acknowledge that standard message and data rates from your wireless carrier may apply
  • The Company is not responsible for any charges assessed by your wireless carrier
  • Check with your wireless carrier for details about your message plan

5.2 Wireless Carrier Limitations

  • Text messages work only on active wireless accounts
  • Wireless carriers are not liable for delayed or undelivered messages
  • Coverage and message delivery may be affected by network conditions

6. Age and Legal Capacity

You represent and warrant that:

  • You are at least 18 years of age (or the age of majority in your jurisdiction)
  • You own or have authority to use the mobile phone number on which you will receive messages
  • You have all necessary rights to enter into this Agreement
  • You are not restricted under any laws or regulations that would prohibit receiving marketing messages

7. Liability Limitation and Disclaimers

7.1 Warranty Disclaimer

THE PROGRAM AND MESSAGES ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS. THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PROGRAM, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Program
  • The Company’s total liability for any claim related to the Program shall not exceed the amount you paid (if any) to participate in the Program
  • The Company is not liable for:
    • Delayed, lost, or undelivered messages
    • Message content, accuracy, or completeness
    • Third-party services or providers
    • Unauthorized access to your mobile device or account

8. Data Privacy and Security

8.1 Information Collection

The Company collects and processes:

  • Your mobile phone number
  • Consent records and opt-in/opt-out history
  • Message delivery data
  • Information you provide when contacting customer service

8.2 Data Use and Retention

  • Your data will be retained for at least 4 years to comply with TCPA requirements
  • Your information will be used only to send Program messages and communicate regarding the Program
  • Your data will not be sold to third parties without your explicit consent

8.3 Data Security

The Company implements reasonable security measures to protect your information. However, no transmission method over the internet or wireless network is 100% secure.


9. Regulatory Compliance

9.1 TCPA Compliance

This Program is operated in compliance with the Telephone Consumer Protection Act (TCPA), which protects consumer rights regarding automated and telemarketed calls and text messages.

9.2 Do Not Call Registry

  • If you are listed on the National Do Not Call Registry, the Company will not send you marketing messages
  • If you place your number on a Do Not Call registry after opting in, notify the Company immediately
  • Contact us by phone or email or simply opt-out of further communication by messaging STOP

9.3 State-Specific Laws

Certain states have additional SMS regulation requirements. If you are a resident of California, Virginia, New Jersey, or Indiana, you acknowledge these states have specific SMS compliance laws that govern your participation in the Program.


10. Dispute Resolution

10.1 Binding Arbitration

Any disputes arising from this Agreement or your participation in the Program shall be resolved through binding individual arbitration, not class action.

10.2 Informal Resolution

Before pursuing formal dispute resolution, the parties agree to attempt to resolve disputes informally by contacting:

11. Intellectual Property

All content, logos, text, graphics, and images in Program messages are the property of the Company or licensed to the Company. You may not reproduce, distribute, or modify any Program content without explicit written permission.


12. Termination

12.1 Termination by Subscriber

You may terminate this Agreement at any time by opting out using methods described in Section 4 above.

12.2 Termination by Company

The Company reserves the right to:

  • Suspend or terminate your participation in the Program at any time
  • Suspend the Program or discontinue service to any region
  • Modify terms with reasonable notice

13. Modifications to Terms

The Company reserves the right to modify these Terms and Conditions at any time. Significant changes will be communicated to you via SMS or email. Your continued participation in the Program constitutes acceptance of modified terms.


14. Third-Party Services

The Company may use third-party service providers to deliver SMS messages and manage the Program. These providers are bound by confidentiality obligations. The Company is not responsible for third-party service failures or breaches.


15. Entire Agreement

This Agreement, including our Privacy Policy, constitutes the entire agreement between you and the Company regarding SMS messaging and supersedes all prior agreements or understandings.


16. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of California without regard to its conflict of law principles.


17. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. TCPA Disclaimer

IMPORTANT: This Agreement includes a requirement for binding individual arbitration to resolve disputes. By opting into this Program, you agree to settle disputes through arbitration rather than in court or through a class action lawsuit.


20. Acknowledgment

By opting in to this Program, you acknowledge that:

  • You have read and understood these Terms and Conditions
  • You consent to receive SMS messages from the Company
  • You have received the Company’s privacy policy and terms information
  • You understand the frequency and types of messages you will receive
